Editor: Toby Graham

Toby Graham is a partner and Head of the specialist Contentious Trusts and Estates Group with Farrer & Co. in London. Toby is described as “an absolute star, he is highly recommended throughout STEP” (Chambers & Partners 2006) and, “an excellent communicator who develops a good rapport with his clients. He is particularly respected as a safe pair of hands in litigation relating to trusts” (Legal 500). Toby received a STEP private client 2007 "outstanding achievement" award. He has extensive experience of trust and estates disputes in England and off shore jurisdictions concerning sham and other validity issues, breaches of trust, Hastings Bass and rectification, third party claims in relation to trust assets, and constructive trusts and tracing claims.

Toby lectures extensively in the UK and abroad. He leads the STEP Advanced Professional Development course, “Attacking and Defending Trusts and Trustees”. Toby is the editor and co-author of Butterworth’s International Guide to Money Laundering Law & Practice and co-author of Butterworth’s Compliance Series title, Money Laundering. He is a co-editor of "A Practical Guide to the Transfer of Trusteeships" published by STEP. Toby is a member of the editorial board of the Wills and Trusts Law Reports.

Dr Tony Molloy QC is a barrister at Shortland Chambers, and QC since 1984. He advises in fiduciary matters, including private, commercial, and political trusts. He has made extensive appearances in trust, tax, and judicial review.

His is the author of books on Property Speculation Tax; Income Tax; Partnership; Estate Planning; Tax Investigations, Disputes and Crimes; as well as Thirty Pieces of Silver, an account of malpractice in NZ’s biggest law firm, which topped the best seller list for 13 weeks. Peters v Davison (1998, NZ Court of Appeal) upheld his
exposure of the infamous “Wine Box” tax frauds in NZ and the Cook Islands.
He also co-authored official reports on which the Domicile Act 1976 was based, and
on the robustness of the NZ tax system.

He lectures each September at the Oxford Offshore Symposium, and has conducted a recent day-long seminar, on the relationship between tax avoidance and tax
evasion, at Cambridge University Law School. He has also written over 50 Conference Papers, including recent addresses to several National Conferences of the Tax Institute of Australia; the World Tax Conference; the International Wine Law
Association; and STEP conferences in Hong Kong and Singapore.

Dr Molloy is also a leading NZ winemaker, under the high-priced St Nesbit label.

Dr. Johanna Niegel is the editor of Trusts & Trustees’ special issue Private Foundations: A World Review, in which she specializes in the comparison of foundations on a worldwide basis.

After having worked with international law firms in Vienna, Budapest, New York and Moscow, Johanna joined Allgemeines Treuunternehmen (General Trust Company), Liechtenstein, in 1999. She is also a member of the STEP Student Liaison Committee, a committee member of its Swiss-German and Liechtenstein Branch Committee, and deputy chairman of its Liechtenstein Centre.

Johanna took a doctorate in law with honours at the University of Vienna Law School and graduated with a masters degree from Columbia University School of Law, New York, having obtained a Fulbright scholarship.

Among others she was awarded Harlan Fiske Stone Scholar for Superior Academic Achievement as well as the Parker School Recognition of Achievement with Honours in International and Foreign Law. She made her first experiences in editing an academic journal as a staff member of the board of editors of The Parker School Journal of East European Law already in 1995.

Johanna speaks German, English, French, Russian and Italian.
